These Terms govern your use of the 45 lb app, published by Gaviso Digital Marketing, LLC ("we", "us"). By downloading or using the app you agree to them. If you don't agree, don't use the app.

Train at your own risk

45 lb is a logging and tracking tool, not a source of medical, health or fitness advice. It does not know your health history, and nothing in the app — exercises, targets, rep ranges, progression suggestions or rest timers — is a personalized recommendation. Strength training carries an inherent risk of injury.

Consult a qualified physician before beginning any exercise program, especially if you have a medical condition, are injured, are pregnant, or are unsure whether an activity is safe for you. Warm up, use appropriate loads and technique, and stop if you feel pain, dizziness or discomfort.You are solely responsible for your own training and for any outcome of it. By using 45 lb you accept these risks.

Your account and data

No account is required — the app works fully as a guest. Sign in with Apple is optional. Your training data belongs to you; how it is stored and synced is described in ourPrivacy Policy, which is part of these Terms.

Acceptable use

Use 45 lb for your personal training. Don't reverse-engineer, tamper with, resell, or misuse the app or the shared exercise catalog, and don't use it in any way that breaks the law or interferes with the service for others.

The app is provided "as is"

We work hard to make 45 lb reliable, but it is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted, error-free, or that data will never be lost — keep in mind that syncing depends on network connectivity and the availability of our sync service.

Limitation of liability

To the fullest extent permitted by law, Gaviso Digital Marketing, LLC will not be liable for any injury, loss of data, or indirect, incidental, special or consequential damages arising from your use of — or inability to use — 45 lb. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.

App Store terms

45 lb is distributed through Apple's App Store, and Apple's Licensed Application End User License Agreement also applies to your use of the app. Where these Terms and Apple's standard agreement conflict on the license itself, Apple's agreement controls; these Terms otherwise add our own conditions, including the health disclaimer above.

Changes

We may update these Terms as the app evolves; the date above will change when we do, and continued use means you accept the update.

Governing law

These Terms are governed by the laws of the jurisdiction in which Gaviso Digital Marketing, LLC is established, without regard to its conflict-of-laws rules.
